Brandy Bottone from Plano was pilled over on 75 for using the HOV lane with only her in the car…but she wasn’t alone. As she sees it, she’s 34-weeks pregnant, and her “unborn baby should count as multiple passengers, given the recent overturning of Roe vs. Wade (and the fact that Texas defines an unborn baby as a person). In response, the officer reportedly said, “I don’t want to deal with this,” handed her the ticket, and told her that if she fought it that she’d “it would most likely get dropped.” She hired a lawyer and is fighting it.
The Texas penal code recognizes an unborn child as a person, but the Texas Transportation Code doesn’t, and since an unborn child doesn’t take up an extra seat, they can’t help meet the requirement to use the HOV lane.
